Welcome to jobply.in ("we," "us," or "Our"). Our service ("Service") is a software tool designed to assist users in automating and speeding up the process of applying for jobs on third-party job platforms ("Job Platforms").

These Terms of Service ("Terms") govern your access to and use of our Service. Please read them carefully.

1. Acceptance of These Terms

By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. You are required to read and accept these Terms before you can use the Service.

By creating an account, logging in to our system, or otherwise accessing or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not log in, access, or use the Service.

2. ⚠️ EXPLICIT WARNING & ASSUMPTION OF RISK

This section contains critical information regarding the risks of using our Service. Please read it with extreme care.

Violation of Third-Party Terms: You acknowledge that many Job Platforms explicitly prohibit the use of automated tools, bots, scripts, or any form of scraping or automated submission in their own terms of service.
Risk of Account Suspension: Your use of our Service to automate job applications is a direct violation of the terms of service of many Job Platforms.
Consequences: Using our Service may trigger alerts on these Job Platforms. This can lead to consequences including, but not limited to, your job applications being rejected, your account on that Job Platform being temporarily suspended, or your account on that Job Platform being permanently terminated or banned.
Your Sole Responsibility: You understand and agree that jobply.in is not affiliated with, endorsed by, or partnered with any of these third-party Job Platforms. We have no control over their decisions.
Assumption of Risk: By accepting these Terms and using our Service, you knowingly, voluntarily, and freely assume all risks associated with its use. This includes the complete risk of your accounts on any and all third-party Job Platforms being suspended, restricted, or permanently terminated.
No Guarantee: We do not guarantee that your account will not be suspended. We do not guarantee that our Service is undetectable by Job Platforms. We provide the tool "AS IS," and you use it at your own peril.

3. User Accounts & Responsibilities

Eligibility: You must be at least 18 years old to use the Service.
Account Security: You are responsible for safeguarding the credentials you use to access our Service (e.g., jobply.in login) and the credentials you provide to our Service to connect with third-party Job Platforms (e.g., your login for those platforms).
Accurate Information: You agree to provide true, accurate, and complete information for your account and to keep it updated.
Your Data: You are solely responsible for all data, information, and content you input into our Service.

4. Prohibited Conduct

In addition to the risks described in Section 2, you agree not to use the Service to:

Violate any applicable law or regulation.
Infringe on the intellectual property, privacy, or other rights of any third party.
Transmit any virus, malware, or other harmful computer code.
Reverse engineer, decompile, or attempt to extract the source code of our Service.
Use the Service for any purpose other than its intended use of applying for jobs for your own personal benefit.
Resell, lease, or sublicense the Service to any other party.

5. Termination

Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.
Termination by You: You may stop using the Service and request to delete your account at any time.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, assumption of risk, and limitations of liability.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

A) THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE;
B) THE SERVICE WILL MEET YOUR REQUIREMENTS;
C) THE USE OF THE SERVICE WILL RESULT IN A JOB OFFER OR ANY COMMUNICATION FROM AN EMPLOYER;
D) THE USE OF THE SERVICE IS SAFE OR WILL NOT RESULT IN ACCOUNT SUSPENSION OR TERMINATION ON THIRD-PARTY JOB PLATFORMS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOBPLY.IN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
C) ANY ACCOUNT SUSPENSION, TERMINATION, OR OTHER ADVERSE ACTION TAKEN AGAINST YOU BY A THIRD-PARTY JOB PLATFORM AS A RESULT OF YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (I) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM OR (II) ONE HUNDRED INDIAN RUPEES (₹100).

8. Indemnification

You agree to defend, indemnify, and hold harmless jobply.in and its employees, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

A) Your use of and access to the Service;
B) Your violation of any term of these Terms;
C) Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
D) Any claim that your use of the Service caused damage to a third party (including a Job Platform).

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
